Terms & Conditions

 

  1. The qualifying product or products must be available to market no later than the beginning of 2023 and will be foreseeably available until the end of 2024, any questions about whether your product or products are eligible then please get in touch.

  2. Companies may enter as many products into as many categories as they wish. Each entry will be treated as a separate entry (although you can enter a range, which counts one entry) and relevant costs will apply.

  3. Payment can be made via credit or debit card and all payments will be acknowledged by a paid invoice, which we aim to send as soon as you have made your purchase.

  4. Entry costs are non-refundable. Entrants should make sure they are paying the correct rate for their membership status before making payment. Please get in touch if the membership rates are not reflected on your dashboard.

  5. All costs associated with entering into the competition are the responsibility of the entering company.

  6. The entrant warrants to The Giftware Association (GA), in respect of each product which it enters, that the product (and any associated packaging) is its own work and has not been copied from any third party work and that the manufacture, importation and any other dealing in the same does not infringe the copyright, design right, trade mark or any other intellectual property right of any third party.

  7. The GA cannot accept responsibility for the late arrival of entries, or the loss or breakage of products at any stage.

  8. Entry samples for the live judging day must arrive by the deadline given on the 'Key Dates' page. There is no guarantee that entries arriving after the deadline can be added to the display though we will always chase products up.

  9. Entry samples MUST NOT qualify as 'commercial samples' according to the HMRC definition: "an imported item that can only be used in the UK as a demonstration sample of goods in soliciting orders for the types of goods they represent from potential customers of that product."   10. Please ensure adequate insurance of product samples.

  11. The judges cannot judge incomplete or inaccurate entry submissions, any such entries will therefore be disqualified.

  12. The judges and The GA reserve the right to reallocate an entry to a different category if appropriate. If this results in the creation of additional entries, entrants will not be charged.

  13. There will be no feedback given on entries, as the judges have to go through a vast amount of entries we can't ask them to give specific feedback.

  14. The judges’ decision is final and there will be no opportunity for appeal.

  15. All judges of the Gift of the Year awards follow a voluntary Code of Conduct covering confidentiality, conflicts of interest and contact with entrant.

  16. From time to time The GA will request samples (free of charge) to use as part of the marketing and promotional campaigns. Winning companies must agree to providing these in a timely manner.

  17. Product samples sent in are donated to the Benevolent Society, an industry charity, once they are no longer being used for promotional purposes. -  https://www.thebenevolentsociety.co.uk/

  18. For all winning and highly commended products, companies commit to participating in all GA activities and promotions to enhance the profile of their products to retailers, trade and consumer press and provide free of charge samples when requested by the GA.

  19. By providing the GA with images of products, the entrant gives permission for the GA to use these images in promoting the Gift of the Year competition.

  20. All logos awarded by the GA to the nominated, shortlisted, highly commended and winning entries must not be displayed with any products other than the product that received the award.

  21. The GA or Gift of the Year logos must not be edited.

  22. The entrant shall indemnify The GA in full, and hold The GA harmless, against all liability, loss, damages, costs and expenses whether direct, indirect or consequential (including without limitation legal expenses) awarded against or incurred or paid by the GA as a result or in connection with any breach of the above warranty or any claim that the product (and/or any associated packaging), or the advertisement of or any other dealing in the same, infringes the copyright, design right, trade mark or any other intellectual property right of any third party.

  23. Entrants are advised not to use the same password on this website as they use on any other website.
